Terms of Use

Effective Date: April 23, 2026

These Terms of Use (the "Terms") govern your access to and use of himmellawfirm.com (the "Website"), which is operated by The Himmel Law Firm (the "Firm"). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. No Legal Advice

The content on the Website is provided for general informational purposes only and is not legal advice. Laws change frequently, and their application varies based on specific facts and jurisdictions. You should not act or refrain from acting based on information on the Website without consulting a licensed attorney about your particular situation.

2. No Attorney Client Relationship

Your use of the Website, including submitting a contact form, sending an email, or requesting a consultation, does not create an attorney client relationship between you and the Firm. An attorney client relationship is formed only after a conflict check has been completed, an engagement letter has been signed by both parties, and the Firm has agreed in writing to represent you.

3. Confidentiality

Information you submit through the Website or by unencrypted email before an engagement letter is signed is not protected by the attorney client privilege. Please do not send confidential or sensitive information to the Firm until you have received confirmation that the Firm has agreed to represent you.

4. Attorney Advertising

The Website may be considered attorney advertising under the rules of New Jersey and New York. Prior results do not guarantee a similar outcome. The choice of an attorney is an important decision and should not be based solely on advertisements.

5. Licensed Jurisdictions

The Firm's attorney is licensed to practice law in the States of New Jersey and New York. The Website is not intended as a solicitation for legal services in any jurisdiction where the Firm's attorney is not licensed.

6. Intellectual Property

All content on the Website, including text, graphics, logos, photographs, and page layout, is owned by the Firm or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print Website content for your own personal use only; any other use, including reproduction, distribution, or commercial use, requires the Firm's prior written permission.

7. Acceptable Use

You agree not to use the Website to:

  • Violate any applicable law or regulation;
  • Transmit any unsolicited commercial communication, spam, malware, or harmful code;
  • Interfere with the operation of the Website or with any other user's use of the Website;
  • Attempt to gain unauthorized access to the Website, related systems, or the accounts of other users;
  • Harass, defame, or threaten any person;
  • Misrepresent your identity or affiliation.

8. Text Messaging

If you participate in the Firm's text messaging program, you are also bound by the text messaging terms set out in the Firm's Privacy Policy, including provisions regarding consent, message frequency, opt out procedures, and fees. Message and data rates may apply. Reply STOP at any time to opt out; reply HELP for assistance.

9. Third Party Links

The Website may contain links to third party websites for your convenience. The Firm does not control and is not responsible for the content, privacy practices, or terms of any third party website; inclusion of a link is not an endorsement.

10. Privacy

Your use of the Website is also subject to the Firm's Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

The Website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, the Firm disclaims all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and noninfringement. The Firm does not warrant that the Website will be uninterrupted, secure, free from error, or free from viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, the Firm shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website, even if the Firm has been advised of the possibility of such damages. The Firm's total liability for any claim arising out of or related to the Website shall not exceed one hundred dollars ($100).

13. Indemnification

You agree to indemnify, defend, and hold the Firm harmless from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising out of your use of the Website or your violation of these Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Website shall be brought exclusively in the state or federal courts located in Union County, New Jersey; you consent to personal jurisdiction and venue in those courts.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Changes to These Terms
